On March 2, 2006, the U.S. Department of Commerce released its final decision in the
“changed circumstances review” of the antidumping duty order on Large Newspaper
Printing Presses from Japan. That antidumping duty order had been revoked for TKS in
January of 2002 based upon a finding that TKS had not been dumping LNPPs for three
consecutive review periods. One month later, the entire order on LNPPs from Japan was
revoked after Goss withdrew from a “sunset review” because Goss had moved its manufac-
turing operations overseas and was no longer a domestic producer.
In its final decision, the DOC has rescinded the revocation and reinstated the order with
respect to TKS from September 1, 2000 through September 3, 2001, the day before the
effective date of the above-mentioned sunset revocation. TKS has challenged the DOC’s
authority to rescind the prior revocation and subject TKS to a “reopened” sunset review for
the express purpose of determining whether TKS’s alleged misconduct relating to the Dallas
Morning News in the 1997-1998 review caused Goss to withdraw from the original sunset
review, resulting in revocation of the order. Contrary to the preliminary determination, DOC is
not making an adverse assumption that TKS was responsible for Goss’ withdrawal from the
original sunset review. Also, the DOC has rejected Goss’ allegations of misconduct by TKS in
the 1998-1999 and 1999-2000 administrative reviews regarding the Atlanta Journal, Columbus
Dispatch and Dow Jones.
TKS is gratified that the DOC’s decision will not require any cash deposits of antidumping
duties on TKS’s entries at this time. The DOC’s final decision will have no adverse effect on
TKS’s current sales and TKS is confident that there will be no assessment of antidumping duties
following the sunset review. Meanwhile, TKS will continue to challenge in the U.S. Court of
International Trade the DOC’s assertion of “inherent authority,” lacking any clear statutory
authority, to conduct the “changed circumstances” review and to issue any decisions regarding
this matter.
